1. Introduction
1.1
This Data Processing Addendum (“DPA”) governs Plenty Labs AB’s (“Plenty Labs”) processing of personal data provided, imported, scraped, and created by you (the “Customer” or “you”) when using the Plenty Labs AI-powered marketing and ad generation platform, including its third-party connectors (the “Service”) under the relevant agreement granting you access to the Service (the “Agreement”).
1.2
By entering into the Agreement, you agree to be bound by the terms of this DPA on behalf of yourself or the company/employer you represent. If you use the Service in connection with your employment or otherwise on behalf of a company, you warrant that you are authorized to bind your company/employer to this DPA. Please do not enter into the DPA on behalf of your company/employer if you are not duly authorized to do so.
1.3
The data protection obligations in this DPA shall apply to the processing of personal data within the scope of the Service (the “Personal Data”) carried out by Plenty Labs (data processor) on behalf of you (data controller). In the event of any contradiction between the DPA and the Agreement, the DPA shall prevail.
2. Processing of personal data
2.1
Plenty Labs undertakes to process the Personal Data in order to fulfil its obligations related to the Service under the Agreement and as instructed by the Customer in Annex 1.
2.2

Plenty Labs shall inform the Customer of such legal requirements prior to carrying out any such processing activities against Customer’s instructions, unless that law prohibits such information. For processing of Personal Data for Plenty Labs’s business purposes, as further described in our Privacy Notice, Plenty Labs acts as independent data controller.
2.4
